Marbury v. Madison was an 1801 Supreme Court case that set the precedent for judicial review.

BackgroundEdit

James Marbury was appointed as a judge by John Adams, the previous President, but the then-Secretary of State John Marshall failed to deliver the commission to him. When Thomas Jefferson became President, James Madison refused to deliver it. Marbury, a Federalist, sued Madison for it. Marbury did not get his commission, but the Supreme Court set the precedent of transcending party lines to make decisions, something modern Republicans at worst do not have the capacity to understand.
